Martin Tate Wins Appeal of Mississippi Corporate Tax Refund Claims

Jackson, MS (September 28, 2009)--The Board of Review of the Mississippi State Tax Commission reversed its denial of Mississippi corporate income and franchise tax refund claims made by an affiliated group of national consumer household products manufacturers and distributors totaling in excess of $1,100,000.

The companies filed Mississippi Amended Corporate Income and Franchise Tax Returns claiming refunds based on issues related to the Mississippi throwback rule. The refund claims were denied by the Mississippi State Tax Commission which claimed an alternative interpretation of the same issue and the expiration of the statute of limitations for filing the refund requests.

Mark Aquadro, a tax attorney with Martin, Tate, Morrow & Marston, P.C., appealed the denial of the refund claims. After a hearing before the Board of Review of the Mississippi State Tax Commission the State reversed its positions and issued the refunds.
